Acceptance of Terms. ourbluefuture.us (“Blue Future + the Youth Progressive Action Catalyst,” “BF/YPAC,” “we,” “us,” “our”), including all site-related content and services provided by Blue Future + the Youth Progressive Action Catalyst (“we,” “us”). Your use of Blue Future + the Youth Progressive Action Catalyst is subject to your compliance with the terms and conditions set forth in this Terms of Use agreement (“Terms of Use”).

You acknowledge and agree that the information and materials presented on or through BF/YPAC will remain the property of BF/YPAC and its licensors or providers, and are protected by copyright, trademark, patent, and/or other proprietary rights and related laws, rules and regulations.
Trademarks.
The trademarks, service marks, logos, and/or trade names displayed on Blue Future + the Youth Progressive Action Catalyst (collectively the “Marks”) are the registered and unregistered trademarks of BF/YPAC, its licensors and suppliers, and others. All Marks on BF/YPAC not owned by BF/YPAC are the property of their respective owners. The Marks owned by BF/YPAC, whether registered or unregistered, may not be used in connection with any product or service that is not BF/YPAC. BF/YPAC logos may not be reused in any manner without explicit authorization from BF/YPAC.
Third Party Content
BF/YPAC may provide third party content on the Site and may provide links to Web pages and content of third parties (collectively the “Third Party Content”) as a service to those interested in this information. BF/YPAC does not control, endorse or adopt any Third Party Content and makes no representation or warranties of any kind regarding the Third Party Content, including without limitation regarding its accuracy or completeness. You acknowledge and agree that BF/YPAC is not responsible or liable in any manner for any Third Party Content and undertakes no responsibility to update or review any Third Party Content. Users use such Third Party Content contained therein at their own risk.
Submissions
You acknowledge and agree that any materials, including but not limited to questions, comments, suggestions, ideas, plans, notes, drawings, original or creative materials or other information, regarding the Site or BF/YPAC that are provided by you in the form of email or other submissions to BF/YPAC, or any postings on the Site, are non-confidential and shall become the sole property of BF/YPAC. BF/YPAC shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these materials for any purpose, commercial or otherwise, without acknowledgment or compensation to you.
Limit on Use
Except as expressly permitted above, you may not copy, reproduce, distribute, publish, enter into a database, display, perform, modify, create derivative works, transmit, or in any way exploit any material produced by Blue Future + the Youth Progressive Action Catalyst. You may not make any editorial changes to articles or materials without first receiving express permission from BF/YPAC. This provision does not restrict excerpting portions of content in a manner that does not alter the editorial intent. If any of these terms are breached, we reserve the right to withdraw your license to republish our material. In this situation, you must take immediate steps to remove our material from all current and past communications.
Disclaimer of Warranties
We do our best to provide accurate and helpful information. However, our Services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that our Services will be error-free, uninterrupted, or secure.
Limitation of Liability
To the fullest extent permitted by law, BF/YPAC and its employees, directors, and officers are not responsible for any indirect, incidental, consequential, or punitive damages arising from your use of our Services, including lost profits, lost data, or personal injury. Your sole remedy if you are dissatisfied with our Services is to stop using them.
Indemnification
You agree to defend, indemnify, and hold harmless BF/YPAC and its employees, directors, and officers from any legal claims, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising from your use of our Services or your violation of these Terms.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. You agree to resolve any dispute with BF/YPAC through binding arbitration in San Francisco, California, except that either party may bring eligible claims in small claims court.

No Assignment
You may not assign your rights or obligations under these Terms without BF/YPAC’s prior express written consent.
Severability
If any provision of these Terms is found to be unenforceable, that provision will be construed as narrowly as possible to reflect the original intent, and the remaining provisions will continue in full force and effect.
No Waiver
BF/YPAC’s failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other right.
Privacy Policy
Blue Future + the Youth Progressive Action Catalyst, a project of Youth Progressive Action Catalyst, (“Blue Future + the Youth Progressive Action Catalyst,” “we,” “us,” or “our”), provides this Privacy Policy to describe how we collect, use, disclose, and otherwise process information when you visit our websites, participate in our programs or events, make a donation, apply for an opportunity, sign up for communications, or otherwise interact with services that link to this Policy—the “Services.”
Information We Collect
We may collect the following categories of personal information (a) directly from you (such as when you contact us, make a donation, contribution, or purchase, complete a survey, or complete a registration form), (b) from third parties, including, for example, our vendors or nonprofits, and advocacy organizations with whom we work, (c) from the device and browser that you use to access the Site, and (d) from cookies and similar technologies.
In addition, the government campaign finance regulators or other agencies may require us to collect certain personal information from donors. For example, the Federal Election Commission (FEC) requires us to collect (and disclose to them) the name, mailing address, occupation, and employer of all individuals whose donations to Blue Future + the Youth Progressive Action Catalyst via the Youth Progressive Action Catalyst, a Federal Hybrid PAC, exceed $200 per calendar year.
Identifiers
We may collect any information you choose to provide, including your name, email address, mailing address, mobile phone number, ZIP code, age or date of birth, employer and occupation, donation and transaction information, volunteer or event participation, program or employment application information, demographic information, interests, preferences, and the contents of your communications with us.
Payment-card, bank-account, and other payment information may be collected and processed directly by a third-party payment processor rather than by Blue Future + the Youth Progressive Action Catalyst.
Inferences
We may also draw inferences from the information that we collect that reflect your preferences, characteristics, and interests.
Device Information
When you use the Services, we and others acting on our behalf may automatically collect information such as your IP address, browser and device information, device identifiers, approximate location, pages viewed, links clicked, access times, referring pages, interactions with communications, and information collected through cookies, pixels, tags, and similar technologies.
Internet Activity
We may collect information concerning your interaction with the Site, including when you access the Site and your browsing activity on the Site (such as which pages you visit, in what order, and for how long). We may receive information from donation processors, event and volunteer platforms, voter-engagement tools, application platforms, social media services, public records, voter files, consumer and political data providers, data cooperatives, advertising and analytics providers, partner organizations, campaigns, committees, nonprofit organizations, and other lawful sources.
We may combine, match, append, enhance, analyze, or derive inferences from information collected through the Services and information received from other sources.
You are not required to provide all personal information identified in this Privacy Policy to use our Service or to interact with us, but certain functionality will not be available if you do not provide certain personal information. For example, if you do not provide certain personal information, we may not be able to respond to your requests.

Organizations receiving information from us may use it for their own purposes, including to communicate with you, solicit donations, advertise, organize, advocate, conduct research, or engage in political, electoral, voter-registration, voter-turnout, or voter-contact activities. Their handling of information is governed by their own policies and practices.
We may use and share aggregated, statistical, anonymized, or de-identified information without restriction where permitted by law. Nothing in this Policy limits our collection, use, retention, or disclosure of information that does not identify and cannot reasonably be linked to an individual.
SMS Terms
We may send SMS or MMS messages concerning Blue Future + the Youth Progressive Action Catalyst, our affiliates, political candidates and campaigns, organizational updates, elections, public issues, organizing, advocacy, volunteer opportunities, voter registration and turnout, voter-contact activities, events, programs, and donation or fundraising requests.
By providing your mobile phone number and affirmatively opting in, you agree to receive recurring automated text messages from or on behalf of Blue Future + the Youth Progressive Action Catalyst at the number you provided. Messages may be sent using automated technology. Message frequency varies. Message and data rates may apply.
Consent to receive text messages is not a condition of making a purchase or donation or participating in a Blue Future + the Youth Progressive Action Catalyst program.
By opting in, you represent that you are the account holder for the mobile number provided or are authorized by the account holder to enroll that number.
Text messaging originator opt-in data and consent will not be shared with any third parties.
Other personal information may be collected, used, and shared as otherwise described in this Privacy Policy.
You may cancel your participation in Blue Future + the Youth Progressive Action Catalyst text messages at any time by replying STOP to any Blue Future + the Youth Progressive Action Catalyst text message. We also honor END, CANCEL, UNSUBSCRIBE, QUIT, and OPT OUT, as well as other messages that reasonably communicate that you no longer wish to receive text messages.
After opting out, you may receive one final message confirming your request. No additional recurring Program messages will be sent unless you subsequently opt in again.
You may also request removal by emailing [email protected] and clearly identifying the mobile number you want removed from our list. Please allow up to 10 business days to process requests submitted outside the text-messaging system.

Message delivery is subject to effective transmission by your wireless carrier and is not guaranteed. Blue Future + the Youth Progressive Action Catalyst may modify, suspend, or discontinue its mobile messaging program at any time.

The Services may link to, integrate with, or embed donation processors, event platforms, voter tools, application forms, social media services, or other websites and services operated by third parties.
Information you provide directly to a third party is governed by that party’s privacy policy, terms, and practices. Blue Future + the Youth Progressive Action Catalyst is not responsible for the privacy, security, availability, or other practices of independently operated third-party services.
Your Choices
You may unsubscribe from promotional emails by following the instructions included in those emails. You may stop text messages as described in the Mobile Messaging Program section.
You may control cookies and similar technologies through your browser, device, or platform settings. Disabling these technologies may affect the availability or operation of certain features.
Where applicable law grants you privacy rights, you may contact us to submit a request. We may take steps to verify your identity and authority to make the request. We may deny, limit, or retain information in response to a request to the extent permitted or required by law, including for campaign-finance, fraud-prevention, security, legal, accounting, recordkeeping, and opt-out purposes. Please note that you cannot unsubscribe from certain correspondence from us, including messages we send in response to an inquiry from you.
Security and Retention
We use administrative, technical, and physical measures designed to protect personal information. However, no transmission, network, database, or storage system can be guaranteed to be completely secure.
We may retain personal information for as long as we determine it is reasonably necessary or useful for the purposes described in this Policy, including political, organizational, fundraising, analytical, historical, legal, accounting, campaign-finance, security, fraud-prevention, and recordkeeping purposes, or for any other period permitted or required by law.
We may retain aggregated, anonymized, or de-identified information for longer periods.
Children
The Services are not directed to children under 13, and we do not knowingly collect personal information directly from children under 13 without legally valid authorization. Please contact us if you believe a child under 13 has provided personal information to us.
